This study established the empirical relationships between domestic and foreign direct investment, and the impacts of absorptive capacity on FDI inflow using Nigeria's time series data form 1975 to 2012. Two multivariate equations were estimated, and using the ECM models with long-run normalized cointegration procedures, results of the analyses reveal that in the long run, FDI and domestic investment impacted positively and significantly on each other (though the variations in domestic investment are not largely accounted for by FDI inflow) and that Nigeria's absorptive capacity was low as each of human capital, financial development and infrastructure accounted for less than 10% of variations in domestic investment and less than seven percent variations in FDI respectively. Human capital development, provision of security, deepening of Nigeria's democracy as well as intervention in electricity generation/transmission/distribution were recommended so as to boost domestic investment and FDI inflow to Nigeria, provide the right climate for economic diversification, and build a knowledge economy capable of competing favourably beyond the 21st century.

Analysis of private domestic investment in Kenya

Private domestic investment is one of the major contributors to economic growth and development in both developed and developing countries. In Kenya the ratio of private domestic investment to GDP has substantial fluctuations. These fluctuations in investment ratio and levels pose a challenge in formulating policies that lead to attaining the desired level of private domestic investment. The Government has been implementing different strategies to boost private domestic investment but it is not clear to which extent each strategy has affected private domestic investment. Policy uncertainty proxied by political instability also undermines private domestic investment in Kenya. This project aimed at studying the determinants of private domestic investment in Kenya from 1970 to 2012 capturing the political instability such as electioneering periods, different economic policies (i.e. the import substitution policy and the export promotion policies), and their impact on the growth of private domestic investment. The effects of elections were captured using a dummy variable for the election years and one year before and after elections.

Ethiopia has devoted itself to entice foreign direct investment across time. The experiences of many countries have shown that FDI has either supplementary or substitution effects. This paper is geared based on the FDI contribution and intends to reveal the path of influence on domestic investment. Accordingly, the result shows that FDI crowds out private domestic investment despite it is being crowd out by domestic investment through private domestic investment. FDI has no effect on domestic investment in the long run and short run dynamics. The result also found public investment has a crowding in effect for both private domestic investments and FDI in both short run and long run dynamics. This shows that FDI might not be increased in the expense of private domestic investment. Finally, This book aid corporations researchers and public interventionist for further endeavors.

Although domestic law plays an important role in investment treaty arbitration, this issue is little discussed or analysed. When should investment treaty tribunals engage with domestic law? How should investment treaty tribunals resolve matters of domestic law? These questions have significant ramifications for both the legitimacy of the investment treaty system and the arbitral mandate of the tribunal members. Drawing on case law, international law principles, andcomparative analysis, this book addresses these important issues.Part I of the book examines three areas of investment law-the 'fair and equitable treatment' standard, expropriation, and remedies-in which the role of domestic law has so far been under-appreciated. It argues that tribunals are justified in drawing on domestic law as a relevant factor in their rulings on these three issues. Part II of the book examines how questions of domestic law should be resolved in investment arbitration. It proposes a normative framework for use by tribunals inascertaining the contents of the domestic law to be applied. It then considers counter-arguments, exemptions, and exceptions to applying this framework, and it evaluates how tribunals have ruled on questions of domestic law to date.Investment treaty arbitration has endured much criticism in recent times, partly over fears of its encroachment on sovereignty. The book ultimately contends that closer attention by tribunals to one of the principal expressions of a state's sovereignty-the elaboration of its domestic law-will reduce criticism of the field.
